Terms:
The following is a list of standard terms and conditions used by photographers, these are provided in the interests of both “the Client” defined as the couple named on the booking form and Anna Pumer Photography (Anna Downing) (“the Photographer”). Please ensure that you have read and understood these terms before placing your booking. The Client is deemed to have accepted the terms and conditions in full upon payment of the booking fee. It is agreed that the terms represent the total agreement made between the parties and cannot be varied in any way by the Client unless expressly agreed by the Photographer in writing.
NON-REFUNDABLE BOOKING FEE The purpose of the £500 booking fee is to secure the Photographer for a particular time and date and is therefore non-refundable and non-transferable in the event of cancellation or postponement by the Client. When paying, please reference the payment [surname&date of wedding]. If moving wedding dates, a new deposit of £500 will be required and it will be considered a cancellation and new booking. If booking 4 hours or less, the deposit is £250.
PAYMENT Full payment of the remaining balance is required no later than the 1st of the month prior to the month of the wedding (so if your wedding is on 30th July payment would be due 1st June). Payment may be made by bank transfer (details below), which should be made payable to Anna Pumer Photography. Dates are only reserved once the booking fee has been received in full. If the balance is not received by the due date, the Photographer reserves the right not to provide any services until payment is received or to treat the contract as cancelled.
ADDITIONAL COVERAGE The Client will be charged £250 per hour for any additional coverage not otherwise agreed up to 48 hours before the wedding day. If adding time on before 48 hours before the wedding day, the fee will simply be in line with current prices. For a full day, coverage usually begins 1.5 hours before the ceremony unless otherwise agreed in advance. The additional fee is payable no later than 14 days after the date of the wedding.
TRAVEL FEES Weddings 2 hours outside of Sussex will incur a travel fee, which will be bespoke based on where your wedding is taking place.
CANCELLATION BY THE CLIENT The Client has a 14 day cooling off period after booking, during which they will receive a refund of all monies paid. After 14 days, in the event of cancellation by the Client, the Client will not receive a refund of the non-refundable booking fee paid. If cancelling after the full balance is paid, the Client will not be returned any money, unless the Photographer books another wedding for the same date, in which case the Client will receive the balance paid minus the booking fee, at the Photographer’s discretion. Should cancellation be received by the Photographer less than 60 days prior to the date of the ceremony, the Client shall pay a sum equal to 75% of the contract value. The sum is payable as compensation as an estimate of the loss the Photographer would suffer having potentially turned other work away.
CANCELLATION BY THE PHOTOGRAPHER In the unlikely event that the Photographer is forced to cancel this contract for reasons beyond control or if unforeseen circumstances prevent wedding attendance (i.e. serious injury/illness or death), liability is limited to a full refund of monies paid to date. The Photographer will use reasonable endeavours to find a replacement photographer of a similar style. However, it may prove difficult or impossible to find an alternative skilled photographer at such short notice and/or at the same contract price. If another photographer is found, the refund of monies will no longer be applicable and the replacement photographer will receive the money. In this instance, The Client has the choice of whether to accept the replacement photographer or take the refund. If two photographers have been booked, and both photographers are unable to shoot the wedding, a single photographer will be hired as a replacement unless two appropriate photographers can be found. If you have booked a second photographer and they cannot attend, you will either be refunded the cost of the second photographer or a replacement will be found and no refund made.
In the unlikely event of a total photographic failure or cancellation of this contract by either party, whether caused by negligence or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. Anna Downing and Anna Pumer Photography will never be liable for more than the total value of the contract.
WEDDINGS ABROAD The Photographer will not be held responsible for missing part or all of the wedding in the event of a flight/train delay or flight/train cancellation. The Photographer will always endeavour to travel out to the destination country 48 hours before the wedding in order to minimise the risk. Flights, accommodation and car hire are not included in the standard price of the wedding photography and will be added on to the invoice. Flights will be charged at economy rate, two nights’ accommodation near the wedding venue and car hire for 3 days will be added.
COPYRIGHT The copyright in all photographs created by the Photographer shall remain the property of the Photographer in accordance with the Copyright, Designs & Patents Act 1988’. The Photographer reserves the right to use the images taken under this contract for advertising, editorial, display and competition purposes or for any other purpose thought proper by the Photographer without compensation or liability to the Client. The Client is forbidden to edit the photos – this includes adding filters, cropping or changing the colours in any way.
IMAGE FILES High-resolution image files are provided via online gallery to the Client for their personal use only and are supplied with the ‘right to print’. The Client is allowed to share online only if they credit the Photographer. No liability can be held for loss or damage to image files after safe delivery to the Client. Your images will be stored in the online gallery for 6 months after the wedding, and you are strongly recommended to download them as soon as you receive them.
EXCLUSIVITY It is agreed that the Photographer shall be the sole professional stills photographer on the wedding day. The Photographer shall reserve the right to ask guests to refrain from taking photographs in the event that their activities are corrupting the official photography in any way. For example flashes, obstruction or distractions etc.
ARTISTIC LICENCE Where possible the Photographer will work with the Client to find the most suitable locations for both background, content and quality of lighting however it is agreed that the Photographer shall be granted full creative and artistic licence regarding locations, poses and groups. The Photographer’s final judgement on photographic style, allocated time and the number of photographs taken shall be deemed correct.
RETOUCHING FEES The Photographer includes standard editing in the cost, such as making basic adjustments (ie lighting, contrast, colour correction) and adding a signature style. It does not include more involved Photoshopping, such as adding or removing anything from the image or doing extensive touch ups. These can be done for an extra retouching fee, to be decided depending on the extent of extra work involved. Under no circumstances will the Photographer edit using selective colour or add in anything that wasn’t present, or change the way people look (apart from removing unexpected spots), and the Client is not permitted to edit the photos in any way. If the Client would like any colour photos in black and white or black and white photos in colour, or any cropping done, there may be a small editing charge for this depending on how many images are involved.
REQUESTED PHOTOGRAPHS The Photographer will use reasonable endeavours to honour requests for specific photographs subject to the weather conditions, time permitting, the availability and willingness of subjects. However, the Photographer cannot guarantee any specific picture nor incorporate any specific background, location or arrangement. The Photographer cannot be held responsible for any lack of coverage caused by the Client or other members of the wedding party or by the church, synagogue, registry office or other licensed place imposing any restrictions on the Photographer. In order to maintain a creative documentary style, the Photographer cannot guarantee a photo of every guest or detail.
IMAGES The Photographer will endeavour to deliver the images (minimum 50 images per hour of coverage) to the Client 12 weeks after the wedding, but this may be slightly longer in the high season (weddings taking place April-September). They will be delivered via downloadable online gallery. The Client has 6 months’ access to this gallery and we highly recommend downloading all images to a hard drive as soon as possible.
MINI FILMS If the Client chooses to have an iphone film, this is 3-5 minutes long and is set to licensed music. It may include minimal ambient audio recording depending on audio quality on the day - we do not use microphones or recorders and just pick up available sound. There will be no full speeches, no full ceremony etc recorded. Audio is only ambient sound, such as cheering. If you would like to choose any specific songs (from musicbed only) these will be at an additional cost of £100 per song used, otherwise the music used is at the discretion of the photographer. Coverage for iphone films is generally ceremony till dancing.
ALBUMS If the Client has purchased an album, the Client has 1 year from the date of the wedding (or date of purchase if purchased after the wedding) to choose the photos to be included and approve the final design, or there may be additional costs in line with inflation.
ENGAGEMENT SHOOTS: These take place before the wedding anywhere within 30 minutes of TN21 0AR or in Brighton unless otherwise agreed.
MODEL RELEASE The Client hereby grants to the Photographer the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included for online and print, editorial, trade, advertising and any other purpose and in any manner and medium. The photographer cannot use photographs in a derogatory or damaging way towards the client.
COVID (If applicable) If you need to postpone your wedding due to covid (only applicable if your wedding is due to take place during lockdown) then you can move your wedding free of charge to a similar date for one instance of postponement. If you postpone a second time a £300 fee will be applicable. If you postpone outside of lockdown, due to not being able to have many guests or similar reasons, a £500 rebooking fee will be applicable. Postponing as a result of anything other than covid lockdown is at the Photographer's discretion. Cancelling your booking entirely incurs the loss of your deposit as stated in the contract, regardless of covid restrictions.
CLIENT DECLARATION By paying the non-refundable booking fee of £500 and signing this contract (by adding your names and date on the booking form below the link to this page), the Client agrees to be bound by the terms of business and would like to book the services of the Photographer for the Client’s wedding day.
# ANNA PUMER PHOTOGRAPHY — CAMCORDER FILM ADD-ON TERMS
These terms apply specifically to the Camcorder Wedding Film add-on purchased alongside an Anna Pumer Photography booking.
The Client’s photography booking remains subject to the main Anna Pumer Photography Terms & Conditions. Where these Camcorder Film Add-On Terms specifically relate to the camcorder film service, these terms will apply.
## 1. CAMCORDER FILM ADD-ON
1.1 The Camcorder Film is an additional service provided alongside the Client’s photography package.
1.2 The Camcorder Film add-on is priced at **£500**, unless a different price is specifically stated on the Client’s booking form or invoice.
1.3 The Camcorder Film is intended to provide a fun, nostalgic and informal record of the wedding day using consumer camcorders and the characteristic aesthetic associated with home video from the 1990s and 2000s.
1.4 The Client acknowledges that the Camcorder Film is a highlights film and is not intended to replace professional full-length wedding videography.
## 2. COVERAGE
2.1 Camcorder coverage will generally run alongside the Client’s photography coverage and will normally cover the wedding day from preparations through to dancing.
2.2 The standard filming period is based on approximately 8 hours of coverage, unless otherwise agreed.
2.3 Coverage will generally begin approximately one hour before the ceremony.
2.4 The exact coverage times will be agreed as part of the Client’s wedding schedule.
## 3. THE FINISHED FILM
3.1 The finished Camcorder Film will be approximately **5–10 minutes long**, depending on the events and footage captured on the day.
3.2 The film is a highlights edit set to music.
3.3 The Videographer does **not** record the full ceremony, full speeches, full readings or other events from beginning to end.
3.4 The film is intended to capture highlights, atmosphere, reactions, candid moments, dancing, laughter and the general feeling of the wedding day.
3.5 The Client acknowledges that not every guest, moment or part of the day will necessarily appear in the final film.
## 4. AUDIO
4.1 No dedicated microphones, audio recorders or professional sound recording equipment are used for the Camcorder Film.
4.2 The finished film is primarily set to music.
4.3 Some ambient sound may be included where it has naturally been picked up by the camcorder and is of sufficient quality to use, such as cheering, laughter or applause.
4.4 No particular audio, speech, vows, ceremony or speeches are guaranteed to be included.
4.5 The Client should not book the Camcorder Film with the expectation of receiving a recording of the ceremony, speeches or vows.
## 5. INSTAGRAM REEL
5.1 Every Camcorder Film add-on includes a **1-minute vertical Instagram Reel**.
5.2 The Reel will be edited from footage captured during the wedding day.
5.3 The Reel is a highlights edit and is not a separate full record of the wedding.
## 6. CAMCORDER AESTHETIC
6.1 The intentionally imperfect nature of consumer camcorder footage forms part of the service.
6.2 The footage may include camera shake, wobbly movement, zooming, imperfect focus, exposure changes, grain, digital noise, blown highlights, low-light noise and other characteristics associated with older consumer video cameras.
6.3 These characteristics are intentional and are not considered faults.
## 7. LOW LIGHT AND PANEL LIGHT
7.1 Consumer camcorders can struggle in very dark environments.
7.2 If the ceremony or another part of the wedding is too dark to produce usable footage, the Videographer may need to use a **small panel light**.
7.3 The Client acknowledges and accepts that a panel light may therefore be visible or used during part of the wedding.
7.4 The Videographer will use reasonable discretion to position and use the light as unobtrusively as possible.
## 8. REQUESTED MOMENTS
8.1 The Videographer will use reasonable endeavours to capture requested moments where possible.
8.2 Specific shots, people, reactions or moments cannot be guaranteed.
8.3 The Videographer cannot be held responsible for missed footage caused by timing, weather, venue restrictions, poor lighting, guests obstructing the camera, changes to the schedule or circumstances outside the Videographer’s reasonable control.
## 9. BOOKING FEE AND PAYMENT
9.1 The Camcorder Film add-on forms part of the Client’s overall wedding booking.
9.2 The remaining balance is payable in accordance with the payment schedule contained in the main photography contract.
## 10. DELIVERY
10.1 The finished Camcorder Film and 1-minute Instagram Reel will be delivered within **2 weeks of the wedding**.
10.2 Delivery will be digital.
10.3 The Client is responsible for downloading and safely storing the finished files.
## 11. COPYRIGHT AND USE
11.1 Copyright in the footage and finished film remains with Anna Downing / Camcorder Weddings.
11.2 The Client is granted a personal, non-exclusive licence to download, keep and share the finished film and Reel for personal use.
11.3 The Client may share the finished film and Reel on personal social media accounts.
11.4 The Client may not sell, commercially license, substantially alter or commercially exploit the footage without written permission.
## 12. RAW FOOTAGE
12.1 Raw and unedited camcorder footage is not included.
12.2 The Client will receive the finished edited film and Instagram Reel only.
12.3 The Videographer is not required to provide unused or unedited footage.
## 13. ARTISTIC LICENCE
13.1 The Client grants the Videographer full creative and artistic licence regarding filming style, camera movement, framing, subjects, editing, music and final film selection.
13.2 The Client acknowledges that the final film will reflect the established Camcorder Weddings style.
## 14. CANCELLATION OR REMOVAL OF THE ADD-ON
14.1 If the Client cancels their entire photography booking, the cancellation provisions in the main photography contract apply to the entire booking, including the Camcorder Film add-on.
14.2 If the Client wishes to remove the Camcorder Film from an otherwise continuing photography booking, the booking fee remains subject to the cancellation terms of the main contract.
14.3 Any refund for removing the Camcorder Film add-on will therefore be at the discretion of Anna Pumer Photography and subject to the applicable cancellation terms.
## 15. CANCELLATION BY THE VIDEOGRAPHER
15.1 If Anna Downing is unable to provide the Camcorder Film service due to serious illness, injury, death or another circumstance beyond her reasonable control, reasonable efforts will be made to find a suitable replacement where possible.
15.2 If no suitable replacement can be found, the Client will receive a refund of the amount paid specifically for the Camcorder Film service.
15.3 The Client’s photography booking will remain unaffected.
## 16. EQUIPMENT FAILURE AND LOSS OF FOOTAGE
16.1 Reasonable precautions will be taken to protect footage.
16.2 However, electronic equipment and digital media can fail and footage may, in exceptional circumstances, be lost, corrupted or rendered unusable.
16.3 In the unlikely event of total or substantial loss of Camcorder Film footage, liability relating specifically to the Camcorder Film service will be limited to the amount paid for that service.
## 17. MODEL RELEASE AND PROMOTIONAL USE
17.1 The Client grants Anna Downing / Camcorder Weddings permission to use footage containing the Client for promotional purposes, including the Camcorder Weddings website, social media, advertising, editorial features and promotional materials.
17.2 The footage will not knowingly be used in a deliberately derogatory or damaging manner towards the Client.
17.3 If the Client does not wish their Camcorder Film footage to be used for promotional purposes, they should notify Anna Downing in writing before the wedding.
## 18. PHOTOGRAPHY TERMS REMAIN IN FORCE
18.1 All photography services remain subject to the main Anna Pumer Photography Terms & Conditions.
18.2 The photography contract continues to govern matters relating specifically to the photography service, including:
* Photography coverage and timings
* Photography delivery
* Photography copyright
* Photography image use
* Albums
* Photography cancellation and postponement
* Photography travel arrangements
* Photography artistic licence
* Requested photographs
* Photographer cancellation
* Photography equipment failure
* Photography model release
* Any other photography-specific terms contained within the main contract.
18.3 Where the Camcorder Film is provided as an add-on, the Camcorder Film Add-On Terms in this document govern the specific filming service.
## 19. CLIENT DECLARATION
By signing the booking form and paying the applicable booking fee, the Client confirms that they have read, understood and agree to the Camcorder Film Add-On Terms together with the main Anna Pumer Photography Terms & Conditions.
The Client wishes to add the Camcorder Wedding Film service to their photography booking.
